The council shall pay the fee to the contractor each month on or around the 1st of each month. The contractor shall pay council 50% of the admission fees above the total monthly base admission numbers.
The contractor warrants that prior to entering into this agreement, they were given a reasonable opportunity to obtain legal advice, have had sufficient time to consider the terms, understand the agreement, and entered into it voluntarily.
The contractor must ensure that it engages sufficient suitably qualified and accredited staff to perform the services. Staff must hold a WorkCover Queensland-approved first aid certificate, RLSSA pool lifeguard accreditation or equivalent, and a pool operators certificate or equivalent if dealing with plant operation. They must also hold a blue card and comply with child supervision legislation.
If the contractor fails to remedy a breach of any provision of this agreement within five days of receiving a notice from council, council may terminate the agreement.
