Townsville City Council is seeking Superintendent & Construction Verification Services for the Leipold Flinders Highway Intersection Upgrade. The contract will be based on AS **** General Conditions of Contract for Consultants. The consultant is an independent contractor. The contract comprises several documents including the formal instrument of agreement and general conditions of contract. Payment is based on a monthly claim date or upon achievement of milestones. The consultant must perform services in accordance with the contract and good industry practice. The client may direct variations. The consultant must comply with legislative requirements and obtain necessary approvals. The consultant is required to prepare a project quality plan. The consultant is not appointed as principal contractor under work health and safety legislation but must be registered and validated in the TCC Management Contractor Management System.
The consultant may submit payment claims on or after each reference date. The client must pay the amount specified in clause 10. 5 within 15 business days after service of the payment claim. The client must pay the amount specified in clause 10. 5 within the period specified in item 8b or, if no period is specified, within 15 business days after service of the payment claim under clause 10. 3.
The consultant warrants that it has examined the contract, including the scope, and all client information to satisfy itself as to the nature and extent of its obligations. The consultant must have the experience, expertise, skill, competence, capacity, and judgement necessary to perform the services and must hold and maintain all necessary competencies, licenses, accreditations, qualifications, permits, clearances, and other authorisations. The consultant represents and warrants that it, and its personnel, will at all times: a Have the experience, expertise, skill, competence, capacity, judgement and other resources, necessary to perform the services and provide the deliverables and properly discharge its obligations under this contract
The consultant indemnifies the client against claims and loss suffered due to failure to achieve completion by the time for completion. The consultant indemnifies the client against any claims and loss suffered or incurred by the client to the extent caused or contributed to by the consultants failure to achieve completion by the time for completion.
