The contract sum is a lump sum and will not be subject to rise and fall adjustments. Payment will be made in accordance with Clause 8 of the Conditions of Contract Consultancy Services, with claims to be made in writing at the times stated in item 8 of Schedule 2, or on or before the last business day of each month if no specific times are designated.
The consultant warrants that it has informed itself with respect to all matters relevant to the performance and completion of the services, has not relied upon information provided by the council, and has entered into the contract based on its own investigations. The consultant also warrants that it will provide the services in a conscientious, expeditious, and workmanlike manner, using its best endeavours, in accordance with the contract, specifications, legislative requirements, Australian standards, and any reasonable direction of the council.
The assessment criteria for this tender include Value for Money (40%), Capability and Capacity (20%), Project Methodology and Program (20%), Environmental Management/Sustainability (10%), Work Health Safety (5%), Critical Assessment (3%), and Innovation (2%).
Proponents must be an acceptable legal entity and hold a registered ABN. They must not be bankrupt or insolvent and must declare any breaches of acts or regulations within the last 5 years. Proponents must also have the minimum level of insurance cover specified in the contract and comply with the NSW Government Code of Procurement.
The contract includes provisions for termination for default or convenience. Failure to comply with essential terms or substantial breaches can lead to termination. The consultant may be liable for costs incurred by the council in completing the services if the contract is terminated due to the consultant's default.
