Guarantees Tenders

The council shall pay the contractor for providing the services in accordance with this agreement. the rate at which the contractor will be paid by the council in the provision of the services is specified in schedule 4 to this agreement.

The council shall, within thirty (30) days of the receipt of each claim for payment submitted by the contractor in accordance with this agreement, process the claim and make the appropriate payment to the contractor.

If the contractor breaches the agreement by failing to perform the services, the council may require the contractor to rectify the breach within 48 hours. Failure to do so may result in the contractor reimbursing the council for costs incurred to rectify the breach.

The contractor shall, forthwith upon becoming aware of the fact, notify the council if any of the warranties set out in Schedule 3 ceases to be true and correct during the term.

If the contractor breaches this agreement by failing to perform the services, the council may give written notice to the contractor identifying that failure and requiring the contractor to attend at the BWMF within 48 hours to rectify the breach. If the contractor fails to rectify the breach, they must reimburse the council for all costs incurred by the council to rectify the breach, including any additional operational costs. The council shall also have the right to an abatement of the fees payable.

The contractor must comply with the WHS Act and Regulation, and any other legislation regulating work practices and employee safety. Failure to do so, or failure to rectify breaches within the specified timeframe, can lead to termination of the agreement and reimbursement of costs.
