The supplier query cutoff is Monday 20 April 2026 11:00 pm E. South America Standard Time.

The closing date for the submission of quotes is Thursday, 23 April 2026, at 2:00 PM Australian Eastern Standard Time. Consultants are responsible for ensuring their quotes are lodged before this closing date.

The contract sum is a lump sum and will not be subject to rise and fall adjustments. Payment will be made in accordance with the contract, with claims to be submitted in writing at specified times or on or before the last business day of each month. Council will assess claims within ten business days and payment will be made within fifteen business days of receiving a valid tax invoice.

The consultant warrants that they have informed themselves of all relevant matters, have not relied solely on information provided by the council, and have entered into the contract based on their own investigations. They also warrant that the services will be provided conscientiously, expeditiously, and in accordance with the contract, specifications, legislative requirements, and Australian standards.

The assessment criteria for this tender include: compliance with quote conditions, completion of the form of quotation and price schedule, compliance with the contract for consultancy services, compliance with specification, satisfactory compliance with capability and capacity, project methodology and program, demonstrated experience in similar projects, commitment to environmental design, and satisfactory compliance with work health and safety obligations.

Proponents must be an acceptable legal entity and hold a registered ABN. They must not be bankrupt or insolvent and must declare any breaches of acts or regulations within the last 5 years. Proponents must also have the minimum level of insurance cover specified in the contract and comply with the New South Wales Government Code of Procurement.

The contract outlines provisions for termination in case of default or substantial breach by the consultant. If the contract is terminated due to the consultant's default, the consultant may be liable for the excess cost of engaging another consultant to complete the services. Failure to comply with essential terms can lead to termination.

The dispute resolution process involves a conference within ten business days of a dispute notice, followed by mediation if unresolved within twenty business days. Specific deadlines for challenging variations are also mentioned within the contract.
