The information documents do not form part of the tender documents and will not form part of the contract. The commonwealth may meet separately with tenderers to obtain information and clarify aspects of the tender and the contract. After the ATM close date and time, the commonwealth may meet with tenderers to obtain further information, conduct interviews, and set aside a tender pending negotiations. The commonwealth is not bound to accept the lowest or any tender. If the tenderer did not lodge a conforming tender, no debrief will be provided unless the commonwealth considers it appropriate. If the tender was unsuccessful, the tenderer will be notified in writing. No payment will be made by the commonwealth for costs, expenses, losses, damages or liabilities incurred by the tenderer arising out of the tender process. The tenderer must ensure that its tender is not prepared by any officer, employee, agent or adviser who was an employee of the Department of Defence or involved in the planning or performance of the contractors activities, the works or the project in the 12 months preceding the tender documents issue date. The tenderer must not place itself in a position that may give rise to a conflict of interest. The tenderer acknowledges that its tender and any other documents become the property of the commonwealth. The commonwealth may use, retain and copy the information contained in the tender for various purposes. The tenderer must comply with commonwealth policies, including those related to indigenous procurement, workplace gender equality, employee entitlements, financial viability, and environmental sustainability. The tenderer must complete specific schedules and forms as required by the tender documents. The tenderer must comply with the Australian Privacy Principles. The tenderer must hold WHS accreditation scheme accreditation if applicable. The tenderer must provide details of any pending, threatened or actual litigation, arbitration or other forms of dispute resolution involving the tenderer. The tenderer must provide a duly executed solvency statement and financial reports, accounts and records as specified.
