The supplier warrants that during the warranty period, a good will not be defective, will be new and unused, and that it is entitled to supply the goods. For a period of 3 years commencing on expiry of the warranty period, the supplier will continue to supply spare parts, replacements, upgrades and attachments, and will supply appropriate substitutes if a good is no longer available.
Where services are not performed in accordance with the service levels, Queensland Hydro may issue a notice to claim a rebate amount calculated in accordance with Schedule 2.
Queensland Hydro may terminate the contract immediately if the supplier fails to achieve the same service level during 3 consecutive periods, or if the supplier has, in the sole opinion of Queensland Hydro, committed an unacceptable breach of a requirement under clause 13. 1b.
