Payment for scheduled work will be made at the tendered rate. For unscheduled work, materials are paid at the supplier's invoice price plus a contractor's markup and GST. Labour is paid at the tendered rate rounded to 15-minute increments. Invoices must be lodged within fourteen working days of completion.
The contract includes warranties for workmanship and manufacturers' or suppliers' warranties for products used in the works, in the name of the principal.
Tender responses will be shortlisted based on completeness of response, local content, past performance, acceptable level of risk to the principal, and price.
Contractors must ensure their employees and subcontractors are of good character, suitably qualified, skilled, and experienced. For certain sites, a valid Working With Children Clearance Notice (Ochre Card) or criminal history check may be required.
Failure to submit a declaration regarding subcontractor payments, submitting a false declaration, or submitting a declaration under subclause aii may result in the preparation of the contractor's performance report identifying failures and/or the retention of unpaid monies by the principal.
A tenderer that has received notification of not being shortlisted is entitled to request a debriefing in accordance with clause 25, as to why their tender response was not shortlisted, at the conclusion of the RFT process.
Failure to inspect the site if required, or failure to be familiar with site rules for NT Fire and Emergency Service assets, will result in the tender being declared ineligible for further consideration.
