The contractor warrants that any goods supplied will be new, of merchantable quality, free from defects, and not non-conforming building products. A 12-month defects liability period applies.
The contractor must be suitably qualified and experienced, maintain necessary experience, and have an appropriately qualified and trained workforce.
No liquidated damages apply, but the council's right to claim general law damages is preserved. The contractor is liable for costs if council rectifies defects due to contractor's failure.
Supplier query cutoff is Monday, 08 June 2026.
The contract may be terminated if the contractor's labour hire licence is cancelled or suspended, or if the contractor fails to comply with its obligations.
