The contract term commences on 28 September 2026 through to the 27 September 2028.

The supplier warrants that the goods will conform precisely in quality and specification with the requirements of the agreement.

If the schedule states that liquidated damages apply to the agreement, then: if the supplier fails to deliver the goods by the date for delivery, it will be indebted to council for liquidated damages at the rate stated in the schedule for every day after the date for delivery until the earlier of the date upon which the goods are delivered and the date that the agreement is terminated.

If it is found that any representation, warranty or other information provided by the supplier, which is of material importance to council, acting reasonably, is found to be incorrect or misleading, then it will constitute a serious breach of this agreement and council may, in its sole and absolute discretion: decide not to place any further order with the supplier or terminate this agreement in accordance with clause 21.

The supplier must deliver the ordered goods by the date for delivery specified in the order. Delivery occurs when goods are unloaded safely at a nominated location and acknowledged in writing by the council. The supplier must deliver the ordered goods by the date for delivery.

Goods shall be delivered free in store (FIS) to council depots or sites within the Rockhampton Regional Council boundaries. The council depot locations are as follows: Rockhampton Depot, Gracemere Depot, and Fitzroy River Water Depot.

Within twenty 20 business days of receipt of a payment claim that complies with clause 18. 3, council will pay the amount of the payment claim, except where council exercises its right under clause 18. 6 or disputes the payment claim.

The supplier warrants that the goods will conform precisely in quality and specification with the requirements of the agreement, be new and of merchantable quality, conform precisely in quantity with the quantity set out in any order, be free from defects in composition, materials and workmanship, and be fit and suitable for their intended purposes.

If the schedule states that liquidated damages apply, and the supplier fails to deliver the goods by the date for delivery, they will be indebted to council for liquidated damages at the rate stated in the schedule.

Supplier query cutoff is Monday 17 August 2026 01:00 am E. South America Standard Time.
