The Town of Victoria Park is seeking proposals for the retail supply and management of gas services to the Aqualife Centre. The contract is for a framework arrangement with an anticipated start date of 1st July 2026 and an end date of two years from the start date. The scope includes the supply of goods described in the scope and specifications, and services described in the specifications. The site for service is the Aqualife Centre at 42 Somerset St, East Victoria Park WA **** requirements include a minimum of $20 million for public and products liability, $30 million for comprehensive motor vehicle and third-party insurance, and workers compensation insurance with a minimum of $50 million for any one occurrence. Professional indemnity and cyber incident insurance are not required. The contract price will be calculated based on rates applied to actual quantities provided, and all rates are inclusive of all costs necessary for the provision of goods and services.
The contract completion date is after two 2 years from the start date of the contract, which is anticipated to be 1st July 2026.
The principal must pay all invoices nett thirty 30 days from the receipt of a compliant invoice, subject to any right of the principal to retain, withhold, reduce or setoff any amount due to the contractor.
Each party represents and warrants to the other party that it has full power and authority to execute the contract and to perform its obligations under the contract, that the contract has been duly executed by it, and that the obligations undertaken by it and set out in the contract are enforceable against it in accordance with their terms.
The Town of Victoria Park invites submissions from suitably qualified suppliers.
If the contractor fails to achieve any or all of the KPIs to the satisfaction of the principal, the principal may serve a notice requiring the contractor to remedy its noncompliance within 14 days. If the contractor fails to achieve the same or another KPI after two or more notices, the principal may terminate the provision of goods and/or services or terminate the agreement.

If the contractor commits an insolvency event, assigns or subcontracts the contract or any part thereof without prior written approval, or any of its personnel are found guilty of any criminal act relating to the goods and/or services, the principal may terminate the contract.
