The contractor warrants that materials and services will not breach third-party intellectual property rights and that defects arising within 12 months of completion will be rectified at the contractor's cost. the contractor warrants on both labour and materials supplied under this contract that where within 12 months of the completion of the service, any defect arises other than from reasonable fair wear and tear in relation to the output of any service performed by the contractor, the contractor shall promptly upon receipt of written notice thereof from the council, at its own cost rectify the defect or reexecute or make good any service not properly performed.

Respondents are required to be suitably qualified and experienced planning consultants with demonstrated expertise in strategic planning and planning scheme reviews. council is seeking quotations from suitably qualified and experienced planning consultants to undertake the 2026 planning scheme review.

Liquidated damages of $500 per day will be applied if services are not provided by the contract end date. if the services are not provided by the end date of the contract, the designated officer shall certify as due and payable to the council, liquidated damages in the amount specified in item 12 of the schedule, for every day after the end date of the contract, until the services are provided to councils satisfaction.

Failure to remedy a breach within a stipulated period, two consecutive unsatisfactory performance reviews, or insolvency could lead to contract termination. a default event default event occurs if a subject to clause 19. 5, the contractor receives 2 consecutive unsatisfactory performance reviews in any period of 6 months b the contractor fails to comply with any of its obligations under this contract and the failure, if capable of being remedied, is not remedied within the period stipulated in a written notice to the contractor

The tender closes on Thursday, 23 July 2026, at 01:00 AM E. South America Standard Time. Submissions must be fully received by the closing time as late submissions will not be accepted.

The council is not bound to accept the lowest priced tender or all or any part of a tender and reserves the right to conduct the request for tender process and select the successful respondents as it sees fit.

Respondents are required to provide a copy of their certificate of incorporation and current company extract if trading as a company, or a registration certificate including the ACN of the trustee if operating as a trust. They must also sign and upload tender schedules and a statutory declaration.

Supplier queries must be submitted by Monday, 20 July 2026, at 01:00 AM E. South America Standard Time.
