Council shall pay the contractor the contract sum. Payment claims must be submitted monthly until the date of completion, or upon issue of a certificate of completion by council. A final payment claim is due within 20 business days from the expiry of the last defects liability period.
The contractor warrants that the warranties provided in the respondents declaration are true and shall continue to be true for the duration of the agreement. The contractor shall, at its cost, rectify all defects during the defects liability period.
The contractor must be suitably qualified to assess, conserve, restore, and document the Marrickville Mosaics Collection in accordance with recognised conservation standards and heritage best practice.
If the contractor fails to complete the works by the date for completion, the contractor shall pay the liquidated damages to council for every day which shall lapse between the date for completion and the date of completion.

If the contractor does not give notice to the contract manager within the time specified for delays or latent conditions, the contractor may not make any claim for additional payment of any kind or an extension of time, and any such claims will be absolutely barred.
