Tenders are sought for the design and construction of civil and electrical works at the Kiah bore field SCA. A pre-tender briefing will be held on site at 11 am on 22 July 2026. The contract is governed by the laws of New South Wales and uses the MW21 General Conditions of Contract. The estimated value of the contract is up to $2 million ex GST for non-complex projects, but MW21 can be used for larger contracts with repetitive works. For complex and high-risk contracts, GC21 edition 2 should be considered. The contract commences on the date of acceptance of the contractor's tender.
The contract includes several milestones with specific completion times. For example, Milestone 1 (approval of project management plans, ITP documentation, project program) is due four calendar weeks after the date of acceptance of the tender. Milestone 7 (completion of testing and commissioning, works as executed drawings, OM manuals, QA records and documentation) is due four calendar weeks after Milestone 6 is complete. The overall time for completion is detailed across seven milestones.
The contractor is to provide a written payment claim monthly, on or after the last business day of each calendar month. Payment by the principal of the scheduled amount is to be made within 15 business days after the contractor's payment claim is served. Payments are made by electronic funds transfer. The principal is entitled to withhold, deduct or setoff from any payment due to the contractor.
The contractor warrants that, before the close of tenders, it has examined the site and surrounds, made enquiries concerning the site, and not relied on the completeness of information provided by the principal. The contractor is responsible for the care of the works and is to make good any loss or damage that occurs.
Tenders are sought from qualified commercial entities. The contract requires the contractor to supply new materials, use standards of workmanship conforming with the contract, national construction code, relevant Australian standards and codes of practice, and lawful requirements of any authority.
If the contractor does not complete a milestone or the work under the contract in accordance with the time for completion, the contractor is to pay liquidated damages at a rate of nil per day. If no rate is stated, common law damages will apply. The principal may also charge delay costs at a rate of **** per day, except for delay after completion of Milestone 6, where the rate is $10 per day.

Disputes must be notified within 10 business days of the act or omission, or expiry of a relevant period. If a dispute is not resolved within 30 business days after notification, an independent expert will determine the dispute.
The contractor may be subject to termination if it commits a substantial breach of the contract, such as failing to carry out an instruction or not carrying out the work at a reasonable rate. Insolvency or serious financial difficulty can also lead to termination or the principal taking over the work.
