The contract states that payment will be made within 15 business days of receipt of a valid payment claim, and a final payment certificate will be issued within 10 business days after receiving the contractor's payment claim issued within the time required after the expiration of the defects liability period.
The contract includes a defects liability period, which commences on the date that the works reach practical completion and lasts for the period stated in the annexure (if not stated, it is 6 months).
The contractor must comply with the requirements of all laws and public or other authorities affecting the works, and unless otherwise specified pay all fees, give all notices and obtain necessary consents.
If the contractor fails to complete the works by the date for practical completion together with any extensions of time granted by the superintendent, the contractor will be liable to the principal for liquidated damages in the amount stated in the annexure for every day after that date until practical completion has been achieved or the contract is terminated.
The principal may, in its absolute discretion, immediately terminate the contract if it believes the contractor has engaged in collusive or anticompetitive conduct, or if the contractor has breached any warranty related to anticompetitive conduct, conflict of interest, or criminal organisations.
