The contractor warrants that materials and services will not breach third-party intellectual property rights and that defects arising within 12 months of completion will be rectified at the contractor's cost. the contractor warrants on both labour and materials supplied under this contract that where within 12 months of the completion of the service, any defect arises other than from reasonable fair wear and tear in relation to the output of any service performed by the contractor, the contractor shall promptly upon receipt of written notice thereof from the council, at its own cost rectify the defect or reexecute or make good any service not properly performed.
