Midcoast Council is seeking experienced tenderers for the design and construction of upgrades at the Gloucester Landfill site. The project includes a clay waste cell lining system, leachate and stormwater infrastructure, a sediment pond, a bitumen hardstand area, and optional entrance road renewal. The works aim to improve site operations and ensure compliance with NSW EPA guidelines. The facility will remain operational during construction. A mandatory site briefing is scheduled for Monday, 13th July at 11 am. Tenderers must confirm they have reviewed all RFT documents, submitted the tender form and return schedules, accepted the MW21 contract documents, and can provide required insurances and evidence of management systems. EPA approved designs and a construction quality report are required.
The tender closes on Friday, 14 August 2026 at 04:00 am E. South America Standard Time.
Payments are made according to the MW21 contract, with progress payments made within 15 business days after the contractor's payment claim is served. The final payment summary is issued within 45 business days after completion or defect rectification.
The contract includes a 52-week post-completion period, which does not limit the contractor's ongoing liability for design, latent defects, statutory warranties, or breach of contract.
Tenderers must provide evidence of their quality, WHS, and environmental management systems, or equivalent evidence if certification is not held. They must also disclose any WHS prosecutions, fines, or regulatory notices.
Liquidated damages may apply if the contractor does not complete a milestone or the work within the specified timeframes, as detailed in the contract.
Attendance at the mandatory site briefing on Monday, 13th July at 11 am is required, or written approval for non-attendance must be obtained from the principal.
Disputes must be notified within 10 business days of the act or omission, or expiry of a relevant period. If not resolved, an expert determination process is initiated.
Tenderers may face disqualification if they fail to provide conforming tenders, do not accept the contract documents, fail to attend the mandatory site briefing without approval, or do not provide required insurances and management system evidence.
