Respondents must provide appropriate public liability insurance noting destination nsw as an interested party. minimum 20 million aud.

if the contractor does not perform the services required, the contractor is not entitled to receive any further payments and must if so required by notice in writing to the contractor by destination nsw, repay to destination nsw all payments made under this contract or such part of the payments as so demanded by destination nsw with respect to expenses already incurred and services rendered to date and must make such repayment within 7 days of the date of such demand by destination nsw or within such longer period as specified by destination nsw.

dnsw may in its discretion, and as part of the evaluation process, invite any or some of the respondents to an interview process, ask them to make personal presentations, or conduct site inspections regarding its response. the respondent shall undertake this at its own cost.

dnsw may cull, set aside, or exclude a response from further evaluation in which destination nsw has evaluated and documented the response as: noncompliant, nonconforming or has not met the mandatory requirements of the request failing to satisfy one or more of the evaluation criteria or criterions by scoring below a pass percentage of 50 not ranked amongst the topranked responses or is ranked as not being an economically advantageous response to which the destination nsws tender evaluation team decide not to shortlist for further due diligence exercises, or include in a shortlisting an operational risk or financial risk or reputational risk or legal risk or work health and safety risk to destination nsw as part of its evaluation, andor as noted as part of due diligence exercises or accepting the response

Evaluation criteria weighting includes financial capacity and solvency.

Evaluation criteria include technical, financial and managerial capability.
