Council is seeking quotations from qualified planning consultants for the 2026 Planning Scheme Review. The review will assess the current scheme, identify improvements, and ensure compliance with legislative requirements. Respondents must submit a detailed methodology, project plan, key milestones, timeframes, and milestone-based fees. The contract includes provisions for intellectual property rights vesting in the council, warranties, confidentiality, and insurance requirements. Liquidated damages of $500 per day apply if services are not provided by the end date. Disputes will be resolved through a nominated person meeting within 14 days of a dispute notice.
The contract end date is to be inserted following selection of the successful tenderer.
Council will pay invoices within 30 days of receipt or 30 days after completion of the service, whichever is later, provided the invoice is valid and the service is authorised.
The contractor warrants that materials and services supplied will not breach third-party intellectual property rights and that defects arising within 12 months of completion will be rectified at the contractor's cost.
Respondents are required to submit a detailed methodology outlining their proposed approach, including a project plan, key milestones, proposed timeframes, and milestone-based fees. Two consecutive unsatisfactory performance reviews within any 6-month period constitute a default event, which may lead to contract termination.
