In submitting a tender, the tenderer warrants that it has all necessary experience, skill and resources to perform its obligations under the draft contract, has not obtained any improper assistance, its tender does not contain any false or misleading claims or statements, complies with all applicable laws, has examined and acquainted itself with the contents of the request for tender, has considered all relevant information concerning risks and contingencies, and is satisfied as to the accuracy, completeness and sufficiency of its tender.

The port is not evaluating offers on the sole criterion of price. The criteria include mandatory criteria (insurance compliance, modern day slavery, previous performance and/or referee reports verified) and qualitative criteria (local content within 125km of goods/services being delivered, capability and capacity, methodology, program of works including berth 1 girder works access scaffolding, berth 1 fire system staging of works, health, safety, environment).

Failure to lodge the EOI submission by the time for submission may result in CQUniversity declining to receive or evaluate the submission. if, for any reason, the respondent fails to lodge the eoi submission at the lodgement address by the time for submission: a cqu may, in its absolute discretion, decline to receive or evaluate the eoi submission

Proposals must be submitted by 4:00 PM on 25 June 2026.

The tenant must pay the rent at the times and in the manner set out in item 8 without demand, abatement, deduction or right of setoff. Outgoings are to be paid to the assessing authority or the landlord within 30 days of demand. Interest is payable on overdue rent or money at the rate fixed under the penalty interest rates act ****.

The landlord makes no promise or warranty that the premises are or will remain fit for the permitted use. The tenant enters the lease with full knowledge of any prohibitions or restrictions on how the premises may be used.

Qualified and experienced cafe operators are invited to enter into the lease.

The assessment criteria weightings are: Price 20%, Past Performance 15%, Local Content 30%, Timeliness 10%, Scope Specific Criteria 25%, totaling 100%.

An industry briefing will be held on Wednesday, 17 June 2026 at 2pm. Attendance is not mandatory, but registration is required.

The NTG may declare a response ineligible for further consideration if tenderers fail to complete Section 2 of the Declaration by Tenderer or fail to provide a marked-up version of the nonstandard conditions of contract.
