The contractor warrants on both labour and materials supplied under this contract that where within 12 months of the completion of the works, any defect arises other than from reasonable fair wear and tear in relation to the works performed by the contractor, the contractor shall promptly upon receipt of written notice thereof from the council, at its own cost rectify the defect or reexecute or make good anything not properly performed.
Quotations will be evaluated on mandatory criteria (risk management, OHS requirements, relevant insurances - pass/fail) and weighted criteria (financial benefit to council - 20%, capability - demonstrated experience in community engagement and relevant industry experience - 50%, capacity - proposed methodology and approach - 30%).
Council is seeking consultants with demonstrated experience in strategic land-use planning, understanding of risk as it relates to settlement planning, engaging with traditional owners and communicating the significance of cultural heritage, rural and regional planning, community consultation and engagement, preparation of structure plans or strategic planning documents, and working with local government organisations. Experience in small town or rural community engagement will be highly regarded.
If the works are not completed by the date for practical completion of the contract, the superintendent shall certify as due and payable to the council, liquidated damages in the amount referenced in item 17 of the schedule, for every day after the end date of the contract, until the works are completed to council's satisfaction.
